  • Employment Tribunal and Employment Appeal Tribunal Fees

    The main types of fees to be paid will be the issue fee when a claim is lodged with the employment tribunal and a fee before a hearing takes place.

    In the employment tribunals there will be two fee levels which are based on the types of claim. These are, in general terms, Type A which applies to Wages Act claims, refusals to allow time off etc. and Type B which applies to most types of discrimination claims and dismissals.

    In the Type A claims the issue fee will be £160 and the hearing fee £230. In the Type B claims the issue fees is £250 and the hearing fee £950.

    There are other fees for interim applications made during the running of the claim. These fees are payable by the party making the application.

    There will be a fee remission scheme where, if the employee can, by way of an application, demonstrate that they are unable to pay the fees then the whole or part of the fee will be waived.

    The tribunals will have the power to order the unsuccessful party to reimburse the fees paid by the successful party.
