Our client visited a local supermarket and fell on petals left on the floor, hitting her knees. Our client was extremely upset as to how the staff at the store handled the incident. Unfortunately, our client had to undergo surgery to one of her knees due to the fall.

Liability was denied by Solicitors for the supermarket who argued that the section of the store our client fell was checked regularly and on the day of the accident, the area was checked 10 minutes before our client fell; the floor was noted to be clean and clear.
Whilst the Courts would probably find that the system of inspection was a reasonable system, we had doubts that the system was actually being followed. Our client attended the store and witnessed several instances of debris in several aisles being left on the floor and to prove her claim, she photographed the debris when first spotted and re-photographed debris later; on occasion, the debris was still present some 30 minutes after.
Our client settled her claim shortly before trial for the sum of £6,000.
