The Marriage (Same Sex Couples) Act 2013 was passed on 7th July 2013 and now allows same sex couples to marry in civil ceremonies. When same sex marriages break down, the process of bringing the marriage to an end is by way of divorce, the same as marriages between a man and woman. We can assist you in the divorce process and deal with any other issues arising from your separation.
Financial matters will also need to be resolved and same sex married couples will be subject to the same rules and principles as that of traditional husbands and wives. We can assist you in recording an agreement reached between yourselves, or in negotiating an agreement as to how the assets of the marriage should be divided. Both parties would need to disclose details of their financial positions as part of the negotiation process. In the event that an agreement cannot be reached we can assist you in making an application to Court regarding financial matters. It is now necessary to make a referral to mediation before Court proceedings can be commenced, unless one of the few exemptions apply.
