The Right to Manage
If you are the tenant of a block of flats The Commonhold & Leasehold Reform Act 2002 means that you and your neighbours may have the right to take over the management of your building without having to purchase the freehold.
The right to manage legislation contains detailed steps that must be complied with and we can help you through each stage of the process.
Why exercise the Right to Manage?
There could be numerous reasons for wanting to take responsibility for the management of your block. You may be dissatisfied with the service provided by the current managing agents and want to appoint new ones. Alternatively you may wish to have more control over the running of the building.
Do I qualify?
The rules can be quite complex but we can help you determine if you meet the qualifying criteria.
In brief the entitlement depends upon the type of property you live in, the length of your lease and how many of your neighbours are willing to participate.
What will it involve?
You need to set up a Right to Manage Company to manage your building which we can assist in. You and your neighbours would run the company, and make decisions together on how your property is managed.
Notice would need to be served on your Landlord and we would prepare and serve the notice on your behalf.
What happens once the right is exercised?
Once you have exercised your Right to Manage, you can dismiss your current managing agents and either appoint an alternative agency, or self-manage. There are advantages and disadvantages to appointing an agent compared with self–management. We can advise on what we consider to be the most appropriate form of management for your building.
